When a Senator Is Appointed
The 17th Amendment has a state fill a Senate vacancy by election and lets the state’s legislature allow the governor to make a temporary appointment until voters fill the seat. U.S. Constitution
Senate records say the date an appointed senator is succeeded by a senator elected to fill the rest of the term depends on a number of factors. U.S. Senate
- Jon Husted, a Republican, holds Ohio’s Class III seat. Senate records list Jon Husted as appointed effective Jan. 18, 2025, with no election to the seat yet. Ohio law has the governor fill a Senate vacancy by appointment right away, and the appointee serves until Dec. 15 after the next regular state election held more than 180 days after the vacancy, when a special election at that regular election fills the seat. If the unexpired term ends within one year after that regular state election, Ohio holds no election for it, and the appointee serves the rest of the term. Ohio’s regular state election is held in November of each even-numbered year. U.S. SenateU.S. SenateOhio lawOhio law
Because the vacancy is filled right away, Jon Husted’s Jan. 18, 2025, appointment places the vacancy after the November 2024 regular state election and more than 180 days before the November 2026 one, and Senate records show no election to the seat since. Ohio’s Class III term ends Jan. 3, 2029, more than a year after that election, so the one-year exception does not apply and the special election is held in November 2026.
- Ashley Moody, a Republican, holds Florida’s Class III seat. Senate records list Ashley Moody as appointed effective Jan. 21, 2025, with no election to the seat yet. Florida law fills a Senate vacancy by election at the next general election, and the governor may appoint a senator to serve until the vacancy is filled by that election. Florida’s general election is held in November of even-numbered years. U.S. SenateU.S. SenateFla. lawFla. law
Senate records show no election to the seat since that Jan. 21, 2025, appointment, and Florida’s next general election is in November 2026, so the vacancy is filled by election then.
- Darline Graham, a Republican, holds South Carolina’s Class II seat. Senate records list Darline Graham as appointed effective July 13, 2026, with no election to the seat yet. Under South Carolina law, a U.S. senator is elected at the general election just before the senator’s term expires. Under South Carolina law, an appointed senator serves until Jan. 3 after the next general election, or until Jan. 3 after the second general election if the vacancy occurs less than 100 days before a general election. Within five days of the appointment, the governor orders an election at the general election before the appointment ends, if part of the term would remain after it ends. South Carolina’s 2026 statewide general election is Tuesday, Nov. 3, 2026. U.S. SenateU.S. SenateS.C. lawS.C. Election Commission
The vacancy came no later than Darline Graham’s July 13, 2026, appointment, more than 100 days before the Nov. 3, 2026, general election. Under this law, the appointment runs until Jan. 3, 2027, the day the Class II term ends, so no part of the term remains for a separate election; the Nov. 3 election fills the seat for the next full term.
- Alan Armstrong, a Republican, holds Oklahoma’s Class II seat. Senate records list Alan Armstrong as appointed effective March 24, 2026, with no election to the seat yet. Oklahoma’s statewide general election on Nov. 3, 2026, includes one U.S. Senate seat. The Oklahoma State Election Board’s 2026 filing packet lists that seat’s term as six years. Under federal law, the winner of the Nov. 3, 2026, election serves a six-year term that starts Jan. 3, 2027, when the Class II term ends.
