This new environment, driven by engagement rather than accuracy, has proven to be an astonishingly efficient engine for the spread of misinformation, disinformation, and malinformation.

What does the First Amendment truly protect? What are the tangible harms caused by misinformation? How do we balance free speech with the need to combat dangerous lies?
The Constitutional Bedrock: What ‘Freedom of Speech’ Means

To win a defamation case, a public official must now prove that the false statement was made “with knowledge that it was false or with reckless disregard of whether it was false or not.”

Inciting Violence: Brandenburg v. Ohio (1969)
In 1964, a leader of the Ku Klux Klan named Clarence Brandenburg gave a speech at a rural Ohio rally, which was filmed by a local television reporter. In the speech, Brandenburg made derogatory remarks about Black people and Jews and spoke of the possibility of “revengeance” if government continued to “suppress the white, Caucasian race.”
He was convicted under an Ohio criminal syndicalism law that made it illegal to advocate for crime or violence as a means of political reform.
The Supreme Court, in a unanimous decision, overturned his conviction and struck down the Ohio law. In doing so, it established the modern, highly protective test for incitement. The Court ruled that government cannot punish inflammatory speech “except where such advocacy is directed to inciting or producing imminent lawless action and is likely to incite or produce such action.”

Xavier Alvarez, a newly elected member of a California water district board, introduced himself at a public meeting by falsely claiming, “I’m a retired marine of 25 years. I retired in the year 2001. Back in 1987, I was awarded the Congressional Medal of Honor.”
This was a lie. He had never served in the military, let alone received the nation’s highest award for valor. He was prosecuted under the federal Stolen Valor Act of 2005, which made it a crime to falsely claim receipt of military honors.
